Judge Dinesh Gupta ruled out a death sentence citing ... that the two had not been involved in any criminal activity prior to the blasts; they hadn’t been shown to be a constant menace to society; and they had been found guilty by drawing inferences from circumstantial evidence.
At the same time, the court questioned the NIA on its clean chit to two other accused, Ramesh Gohil and Amit, as well as “suspicious persons” such as senior RSS leader Indresh Kumar, Pragya Singh, Rajenda Chaudhary and Jayant, stating that it could not be done without invoking appropriate sections of the CrPC.

The Mercy Petitions
Savarkar was lodged in the Cellular Jail on July 4, 1911. Within six months, he submitted a petition for mercy. He spent 10 years in cellular jail and then 3 years in a normal one, during which he wrote several cringe mercy petitions begging and offering to collaborate completely with the British.
After release, he wrote: “I heartily abhor methods of violence resorted to in days gone by, and I feel duty-bound to uphold Law and the constitution…”
For sure, Savarkar was no Nelson Mandela.
But Other Freedom Fighters also wrote mercy petitions
Ram Prasad Bismil - Bismil did indeed filed a mercy appeal to the Privy Council, but as he writes in his autobiography:
“politics is a game of chess, and sometimes in chess you have to sacrifice your pawns…I knew that we were going to be sentenced for death but we only wanted to expose the Government which claimed that those revolutionaries who repented will be forgiven…the fate of our appeal only exposes the British Government’s double speak”.
But he did not apologize for his deeds
After confessing that he was misguided into taking the revolutionary road because of the “excited and hopeless situation of India in 1906-1907”, he concluded his November 14, 1913 petition by assuring the British of his conscientious conversion. “[I]f the government in their manifold beneficence and mercy release me,” he wrote, “I for one cannot but be the staunchest advocate of… loyalty to the English government (emphasis added)”.

Narcissism
A book titled Life of Barrister Savarkar authored by Chitragupta was the first biography of Savarkar, published in 1926. Savarkar was glorified in this book for his courage and deemed a hero. It was revealed in 1987 that Chitragupta was in fact Savarkar himself.
In this autobiography masquerading as a biography written by a different author, Savarkar assures the reader that:
“Savarkar is born hero, he could almost despise those who shirked duty for fear of consequences. If once he rightly or wrongly believed that a certain system of Government was iniquitous, he felt no scruples in devising means to eradicate the evil.”
